Our Open Letter to Florida Gov. Rick Scott!

Please Sign Bill 668 For the Children of Flordia

Dear Governor Scott,

The Men’s Rights Group of Arizona strongly urge you to sign SB 668. This Bill will bring Florida into the 21st Century with Alimony Reform and require shared parenting time.

Florida’s current Alimony Laws are archaic and more closely resemble the family and economic structures of the 1950’s than the realities of the many family forms of 2016.  SB 668 will bring economic justice and equal opportunity to divorcing husbands and wives as well as enhancing harmony in the post-divorce family by attenuating conflicts over money.

Your state’s Bill (SB 668) is widely supported in your state and allow for a more equal shared parenting component currently missing in family law. The Men’s Rights Group of Arizona believe Family Law should follow sociological research.  One of the most consistently and strongly replicated findings in family social science research is that the children of divorce fare best in family forms that maximize the involvement of both parents in the child’s life.  The worst developmental outcomes come from single mother families which are supported by current women headed households.

In 2013, Arizona passed the first joint parenting law in the nation and it has been a great success. The Men's Rights Group of Arizona along with many other organizations have followed this new law and it showed children are thriving as compared to mother headed households.

Sole custody to one parent is actually the removal of constitutionally protected parental right.


The threat to parental rights in America is a result of the precarious current standing of these rights in the courts.


The Supreme Court has identified specific categorizes of rights that are protected by the Constitution. A right may be fundamental or non-fundamental, and it may be either an explicit right or an implied right. The right of parents to direct the upbringing and education of their children is a fundamental, implied right.

ABOUT FUNDAMENTAL RIGHTS

Fundamental rights include, among others, the freedom of speech and expression, the right to participate in elections, and the right to be shielded from racial discrimination. Before infringing on these rights, the government must first demonstrate that it has an interest "of the highest order" and that it is using the "least restrictive means."

The burden of proof is placed squarely on the shoulders of the government. On the other hand, non-fundamental rights receive far less protection. The government only needs to show that it has a rational reason to restrict non-fundamental rights: the burden of proof is on the citizen to show that the state’s actions are irrational and illegitimate.



ABOUT IMPLIED RIGHTS

The Court also recognizes a distinction between explicit rights and implied rights. An explicit right – such as the freedom of speech or the right to be free from cruel and unusual punishment – is expressly stated in the black-and-white text of the Constitution. An implied right, on the other hand, must be drawn from other general provisions of the Constitution, which imply (in the Court’s determination) that the right exists. The Court then undertakes to define what protections this implied right merits. Throughout our history, courts have consistently ruled that implied rights are entitled to the same protection as explicit rights.

We Publicly Declare that every election everywhere from this day forward will center around whether or not the candidate has lived a life of pushing for Family Court Reform that focuses on 50/50 Shared Parenting!!!

"The family courts continue to award sole custody to one parent after separation or divorce, ignoring the proven harm sole custody does to children compared with shared parenting (joint physical custody). And where does this authority come from? A so-called 'award' of sole custody to one parent is actually the removal of constitutionally protected parental rights from the other parent without any demonstration of a compelling state interest if both parents are fit." ~ Ned Holstein

So you think you are an advocate for change in family law??

If you cannot answer the following questions, then you are not and need to do your research:

1. Can you identify where your state’s statues concerning family are located on line?
2. Can you locate your state’s Rules of Civil Procedure are on line?
3. Can you identify where your State’s Rules of Evidence are on line?
4. Can you identify where your local county rules are on line?
5. Do you know where to find your own docket on line?
6. Can you identify the Amendment of the U.S. Constitution that places the right to decide matters of the family solely with the states?
7. Do you know the difference between a fundamental right and a Constitutional right?
8. Do you know who you state Senator or State Representative is? And where to find it?
9. Can you identify the exact language within your state law that is the problem?
10. Can you present the problem to legislators without talking about your own case?
11. Do you know the difference between the two types of child support?
12. Do you know how federal incentives really work and what they really give the states money for?
13. Do you read case law and do you know where to find it on line?
14. Do you know what questions will be asked of you by a legislator if you propose a change in family?
15. Do you know how to defeat the opposition’s stance when they bring it up?

Answer no to any of these questions and you are not an advocate and still have a lot to learn.

For far too long, the judicial branch of government has operated above the very laws they seek to enforce on society. They sit in judgment of citizens with no check and balances.
This is clearly not constitutional.

We believe this Cause helps all of us, especially our children - and the Future.
We need to take Absolute Judicial Discretion AND Immunity off the table in FAMILY COURT.
We need to hold the entire Judicial Community responsible for the actions and decisions made by Family Court Judges when PROOF of injury, loss of property, self and other family and so on.

So let me remind you about a little town called Birmingham in 1956 a group of men from Miles College orchestrated a boycott. You see annually the black community spent approximately $3 MILLION dollars during the Easter Holiday in downtown Birmingham stores. After the first year stores in that area, like JC Penny's and Loews, began to allow blacks to access the water fountains and bathrooms, cafeterias, and so forth. Look it up because it's a great story. Can you imagine what those men could have dome if the internet existed in 1956??

Our talents, health and productivity are being lost to a litigious system focused on the ever elusive child’s best interests. We have come a long way since the Dred Scott decision.
Here "I" am...a white civil rights advocate petitioning a black president for equal rights. Yet it is much more than that. A father is asking another father to help preserve future generations of Americans. Being an activist/critic goes against my basic desire for privacy. Yet, circumstances compel me to write.
