By concentrating our resources wisely by going to the precincts with the most number of voters.

Is There Really a Fatherhood Crisis?

Virtually every major social pathology has been linked to fatherless children: violent crime, drug and alcohol abuse, truancy, unwed pregnancy, suicide, and psychological disorders—all correlating more strongly with fatherlessness than with any other single factor. Tragically, however, government policies intended to deal with the “fatherhood crisis” have been ineffective at best because the root cause is not child abandonment by fathers but policies that give mothers an incentive to initiate marital separation and divorce.

During the past decade, family issues such as marriage and fatherhood have rocketed to the top of the domestic-policy agenda. The past two presidential administrations, along with numerous local governments, have responded to the continuing crisis of the family by devising measures to involve governmental machinery directly in the management of what had previously been considered private family life. The Bush administration has proposed $300 million annually to “promote responsible fatherhood” and for federal promotion of “healthy marriages.” Earlier, President Bill Clinton created a “Presidential Fatherhood Initiative,” and Vice President Al Gore chaired a federal staff conference on “nurturing fatherhood.” Congress has established bipartisan task forces on fatherhood promotion and issued a resolution affirming the importance of fathers. Almost 80 percent of the respondents to a 1996 Gallup poll saw fatherhood as the most serious social problem today (NCF 1996).

A generation of fatherhood advocates has emerged who insist that fatherlessness is the most critical social issue of our time. In Fatherless America, David Blankenhorn calls the crisis of fatherless children “the most destructive trend of our generation” (1995, 1). Their case is powerful. Virtually every major social pathology has been linked to fatherless children: violent crime, drug and alcohol abuse, truancy, unwed pregnancy, suicide, and psychological disorders—all correlating more strongly with fatherlessness than with any other single factor, surpassing even race and poverty. The majority of prisoners, juvenile detention inmates, high school dropouts, pregnant teenagers, adolescent murderers, and rapists come from fatherless homes (Daniels 1998, passim). Children from affluent but broken families are much more likely to get into trouble than children from poor but intact ones, and white children from separated families are at higher risk than black children in intact families (McLanahan 1998, 88). The connection between single-parent households and crime is so strong that controlling for this factor erases the relationship between race and crime as well as between low income and crime (Kamarck and Galston 1990, 14).

Given these seemingly irrefutable findings, a case might be made that both liberals and conservatives should rethink their priorities. Rather than spending more on antipoverty programs, as the left advocates, or on ever harsher law enforcement, beloved of the right, both sides should get together and help restore fatherhood as a solution to social ills. On its surface, the government’s fatherhood campaign seems to make good sense. As currently conceived, however, it may be having precisely the opposite effect of that advertised.

Clark, who identifies herself as a “Floridian-American,” claims that her civil rights were violated five years ago when she was arrested for plotting to break the father of her baby out of prison.

Fittingly, her memo is full of what is, to say the least, a dismissive attitude towards Judge Willis Hunt and other agents of the government.

“You think because you sit up there in that little black robe hiding behind the ignorance of the masses like a little b*tch, that ANYBODY gives a d*mn about you or what you have to say?” Clark says. “Well, just in case you haven’t noticed-I couldn’t give two f*cks about you or what you have to say. F*ck you, old man. You’re a joke. Your court’s a joke. You take it up the a*s; and you suck nuts. Lol.”

The Effects of Family Court Can Be Traumatic.

It’s important the family know that Mr. Koziol is working diligently within the system to secure long overdue reform in domestic relations matters given the related escalation of violence. A more ominous sign may exist here in our own small community in Upstate, NY, where a number of of law enforcement officers were victimized both on duty and off duty by domestic relations abuses.

According to research[1] approximately 330 people commit suicide monthly in the U.S. in response to the way family courts and CPS handle divorce, domestic violence and child support. The study points out that the suicide rate for divorced men is 9.94 times higher than the suicide rate for divorced women.

A Father's Nightmare ~ Hold Judges Gone Wild Accountable!!

Has a judge violated your constitutional rights?

Although it is almost impossible to recover monetary damages from a judge (unless you can prove he or she acted ultra-vires beyond his or her legal jurisdiction) it is in fact possible to obtain relief in equity against a judge through civil rights actions. Equitable relief includes:

declaratory relief - (rulings by another judge in the form of opinions establishing the constitutionality or lack of constitutionality of another judges actions.) injunctive relief - a command or order to do something or refrain from doing so.

"The biggest frustration most people have in court, is the lying. In theory, no one is lying, because testimony is taken under oath. In reality, every case is riddled with lies, half truths, shades of fact and the greatest of all, the omission of a critical fact that totally changes the situation.

In the court’s eyes, as a lawyer I’m supposed to be the champion for my client, and I’m expected to have vetted their testimony to make sure that it’s true. Most of the time I’ve spent a great deal of effort to explain to the client that judges hate liars and I coach them to be as truthful as possible.

Inevitably when I get in to a child custody hearing or a divorce trial, it gets heated and the cries of “He lied!” or “She’s committing perjury!!” “That’s a lie!” start.

In every courtroom, those phrases are said, every day. And frequently it’s true. Some days it’s her, and some days it’s him, but no matter what, someone, somewhere is shading, spinning, omitting or outright lying.

I know it. You know it. The judge knows it.

The angry and frustrated clients always say “Put her in jail!” That’s not going to happen so much. Judges can’t put away everyone who lied in court, there’d be no room for the real criminals.

So what’s the point of having people testify under penalty of perjury, if there’s no penalty ? Well, it’s about credibility. Once a judge knows, or even suspects, that someone’s lying to the court, their credibility goes out the window.

I had a case earlier this year, where the ex-wife said she was married in a Michigan court, and then said she was single in a California court. The judge looked at the other lawyer and said, “so either she lied in Michigan, or she lied in California, either way, she’s a liar!”

It was a bad day for that lawyer, because now they’re fighting up stream with a judge who’s experience with the client is that she’s not to be trusted. In Family Court, when the judges are making decisions on issues like who should be the primary custodial parent, that sort of taint can kill your case.

Which is why I always advise my clients that lying is a very bad thing. No they’re not going to go jail, but they’ll never have the same, and in some courts any, credibility again.

The question then becomes how to prove your case, if you know you’re dealing with a liar. Fighting a lie, is like shadow boxing, for so often it comes down to: he said, she said. Generally the best way to get rid of the shadow is to turn on all the lights and face them to your accuser and make them fight a battle that they don’t want.

If my client is accused of being a pot smoker, we provide the prescription, then we attack with bad parenting and lack of time to devote to the child. That’s how we fight a war, in which there are no winners.

The report found that young people accused of wrongdoing in family court often lacked adequate legal representation, were held without proper determination of probable cause, and sometimes pleaded guilty without fully understanding the consequences.

For the family court investigation, Justice Department officials analyzed data from nearly 33,000 juvenile cases, and looked at court records, transcripts, policies and procedures and external reports.

It also alleges that black children were nearly 1½ times more likely than whites to have cases handled formally, rather than through diversion or other informal means. They were 2½ times more likely to be detained before going to trial, and three times more likely to be sent to the Division of Youth Services for parole violations.

Gupta said in the letter that several factors contribute to the problems, including the "staggering caseload of the sole public defender" handling delinquency cases, an "arbitrary" system of choosing who gets a public defender, and other issues.

She also criticized the organizational structure of the court, in which "the probation officer acts as both an arm of the prosecution as well as a child advocate." That setup is "contrary to separation of powers principles," Gupta wrote.
