Evidence inadmissible because it is the primary product of an unlawful act or because it was obtained by the exploitation of an unlawful act:
18 U.S. Code § 3504 - Litigation concerning sources of evidence
(a) In any trial, hearing, or other proceeding in or before any court, grand jury, department, officer, agency, regulatory body, or other authority of the United States—
(1) upon a claim by a party aggrieved that evidence is inadmissible because it is the primary product of an unlawful act or because it was obtained by the exploitation of an unlawful act, the opponent of the claim shall affirm or deny the occurrence of the alleged unlawful act;
(2) disclosure of information for a determination if evidence is inadmissible because it is the primary product of an unlawful act occurring prior to June 19, 1968, or because it was obtained by the exploitation of an unlawful act occurring prior to June 19, 1968, shall not be required unless such information may be relevant to a pending claim of such inadmissibility; and
(3) no claim shall be considered that evidence of an event is inadmissible on the ground that such evidence was obtained by the exploitation of an unlawful act occurring prior to June 19, 1968, if such event occurred more than five years after such allegedly unlawful act.
(b) As used in this section “unlawful act” means any act the use of any electronic, mechanical, or other device (as defined in section 2510 (5) of this title) in violation of the Constitution or laws of the United States or any regulation or standard promulgated pursuant thereto.
the only thing that should be allowed as evidence in a case where they re trying to get support is proof of paternity , dna should be mandatory ! here in pa , if your name is on the birth certificate , then your are the father regardless of evidence otherwise . and that is bull sh*t ! child support should be paid by the "father " but hitting a man who is`nt the father is insane ! way past time to fix this crap nationwide ! a lot of men who have been victimized by women and the courts are owed this much !
The above mentioned code is for criminal cases only.....family law is in the civil arena.....with its own set of rules, that should run parallel to the Federal Rules of Civil Procedure......
Thanks for your comment. However...if a parent in Family Court uses a false "police" report that details an incident of "alleged" domestic violence that never happen then IT IS APPLICABLE. If a parent in Family Court is ordered to a Psych Eval and the Court Appointed Psychologist (acting only in a forensic capacity) reports to the Family Court Judge information obtained from the parent's psychiatrist/psychologist's (diagnosis - assuming there is one) AND the Psychiatrist is later charged...

It's sad that Medal of Honor recipient Dakota Meyer even has to file for custody of his own child. This is an American hero who, under heavy enemy fire, found four dead soldiers stripped of their weapons, extracted another 12 friendly wounded and provided cover for another 24 marines to escape an area inhabited by insurgents.
Sarah Palin says he is asking for custody in an attempt to "save face".
Really Sarah Palin? Are you this much of a hypocrite who pretends to be so all American that the best response you can come up with is to attempt to slander the reputation of an American hero?
You should be ashamed of yourself Sarah Palin.
Meanwhile Bristol Palin attempted to keep her first son's dad away from him as well. What a sad state of affairs that every time you have a child with a man you need to attempt to keep that child from his father.
I hope Dakota Meyer gets equal custody, and he should get child support if Bristol Palin makes more money than him. Because child-support, remember, isnt about supporting the parent it's about supporting the child. So the lawyers saying that him asking for child support is a disgrace because he is a Medal of Honor recipient, is the most hypocritical thing I've ever heard. These lawyers always want to talk about child support Bing about the child, until a man asks for it.
Bristol Palin should do the right thing and allow her child to have a father. If not I hope the courts of Alaska do the right thing and allow this American hero equal access to his child. ~
