-- August 25, 2015 What happens when a parent’s statutory right to make decisions comes against a court order to the contrary? If the child is in the custody of the state of Maine, the answer is very much up to the judge. That’s the take away from the decision In Re: Z.S. handed down by the Maine Supreme Judicial Court last week. According to Maine law, parents have a statutory right to opt their child out of the state’s general vaccination requirement based on a sincerely held religious belief or other philosophical exemption. The mother of Z.S. had chosen to exercise that right based on her beliefs regarding vaccines and disease. At issue in the appeal from a lower court was whether the lower court judge could override this statutory right (a right reserved explicitly by state statute) without first terminating the mother’s parental rights.Ordinarily, termination of rights requires the high “clear and convincing evidence” standard, while a custody ruling requires only a “preponderance of the evidence” standard. In this case, the mother was found to be negligent based on accusations not related to vaccines. The “preponderance” standard was met and the child was held in state custody. But in his custody ruling the judge also called for the Child Welfare department to override the mother’s statutory right to opt out of vaccination while the child was in custody. The mother appealed this violation of her statutory right.

As it stands now, shared parenting of 50/50 is not an automatic when a couple gets divorced. If both parents are not being accused of abuse, neglect, etc, then it should be an automatic that they both receive 50/50 time share parenting with their children.
Both parents have equal standing raising children after a separation or divorce.This preserves a strong bond between children and their parents which is critically important to children's emotional, mental, and physical health. Gender equality and a strong presumption of shared parenting embraces every issue separating children from loving fathers and mothers, grandparents, and other relatives.
How do the courts transform a stay-at-home parent into a parent who only gets to spend every other weekend with the kids? The Legislative intent of the State of Florida and the Florida Statutes reflect a presumption of "shared custody," but fails to define what that means. As a result, judges routinely assign one parent primary custody and limit children to spending 4 days or less per month with the other parent. If a judge feel it is in the best interest of the child to spend less time with one parent, the judge should be required to specify what steps the noncustodial parent needs to take in order to be granted equal time with the child.

We The People of the United States of America support criminalization of all custodial parents in divorce and custody cases that voluntarily withhold their children from the non-custodial parent for whatever reason they deem fit.
We The People recognize that father's have rights too and that father's desire to be a part of their children's lives; NOT to be treated like human automated tellers by the family court system.
We The People support a fiduciary accounting of child support payments, to be required of custodial parents, whom receive any state welfare assistance, and/or child support from non-custodial parents.
We The People support the removal of prison from the punishments of which can be applied to non-custodial parents in default of child support.
Tell states to make equal parenting time the standard in all divorce cases where both parents are fit and proper.
In an effort to benefit children of divorce, all states should begin all child custody cases with a 50/50 split in parenting time. We understand that some men and women are unfit to parent, and judges should rule accordingly in the best interest of the children. If both parents are found to be fit and proper an equal parenting time arrangement should be the standard. Research shows that children of divorce benefit greatly with the opportunity to have a fair and equal relationship with both parents. All across our country the future and well being of our children are being put at risk from unfair parenting arrangements handed down from judges in cases that never even go to trial. Kidnappers and Angry Parents who Alienate Children from the other Parent: Be prosecuted for their hate crimes, kidnapping and child abuse.
Parental Alienation aka "legal kidnapping" has become an out of control epidemic in our nation (US) and other areas that copy our family court functions. Anyone who denies access from a parent to their child is kidnapping. We petition that these individuals be prosecuted for their crimes.

We petition the Obama Administration to: Stop the unfairness in courts - We know the federal incentives are the reason for the unfairness. Custody should be 50-50% and each parent supports the children during their time with the children. With 50-50% custody there should be no reason for anyone to pay child support. A child has the right to BOTH PARENTS. And no judge, court or anyone else has the right to say that one parent is better then the other.
We only support organizations who show an understanding that children need both parents, and that either parent is equally capable of the choice to perpetrate hate or declare peace.
